AMENDMENT LANGUAGE

State Constitutional Provisions

  • Nev. Const. art. 11, § 2: "…any school district which shall allow instruction of a sectarian character therein may be deprived of its proportion of the interest of the public school fund during such neglect or infraction…"
  • Nev. Const. art. 11, § 9: "No sectarian instruction shall be imparted or tolerated in any school or University that may be established under this Constitution."
  • Nev. Const. art. 11, § 10 (1880): "No public funds of any kind or character whatever, State, County or Municipal, shall be used for sectarian purpose."

IMPLEMENTING STATUTES AND REGULATIONS

Statute

  • N.R.S. 387.045:

"1. No portion of the public school funds or of the money specially appropriated for the purpose of public schools shall be devoted to any other object or purpose.

"2. No portion of the public school funds shall in any way be segregated, divided or set apart for the use or benefit of any sectarian or secular society or association."

State Courts

  • State v. Hallock, 16 Nev. 373 (1882), 1882 WL 3785 (Nev. 1882) (finding that public money given to Catholic orphanage violates Art. 11, Section 10 of the Nevada Constitution, which prohibits any public funds from being used for a sectarian purpose).
